Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Starmy ("Starmy", "we", "us" or "our") governing your access to and use of the Starmy website, mobile application, and related services (together, the "Service"). By creating an account, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, you must not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service you represent that you meet these requirements and that the information you provide is accurate and current.

2. Important: information only, not migration advice

Starmy is an information and self-service tool. We are not a registered migration agent, lawyer, or financial adviser, and we do not provide migration assistance within the meaning of the Migration Act 1958 (Cth). Content, points estimates, EOI rankings, checklists, and AI assistant ("Stella") responses are general information only, may be incomplete or out of date, and must not be relied on as professional or legal advice.

You are solely responsible for verifying any information with the Department of Home Affairs and, for personalised advice, a registered MARA agent or Australian legal practitioner before acting. We are not responsible for visa outcomes, decisions, or any consequence of relying on the Service.

3. AI assistant (Stella)

Stella is an automated assistant that generates responses using third-party AI models. Output may be inaccurate, incomplete, or unsuitable for your circumstances. Do not submit sensitive personal data you do not want processed, and always independently verify any AI output. Usage may be limited per plan and we may change or withdraw the feature at any time.

4. Accounts

You are responsible for safeguarding your login credentials and for all activity under your account. You must promptly notify us of any unauthorised use. We may suspend or terminate accounts that breach these Terms or that we reasonably believe pose a security or legal risk.

5. Subscriptions, billing and refunds

Most features are free. Optional paid plans (e.g. Starmy Pro) are billed in advance on a recurring basis through our payment processor (Stripe). Prices are in Australian dollars and include GST where applicable. Subscriptions renew automatically until cancelled; cancellation takes effect at the end of the current billing period and you retain access until then.

Nothing in these Terms limits your rights under the Australian Consumer Law. Except where required by law, payments for completed billing periods are non-refundable. We may change pricing on reasonable notice; changes apply from your next renewal.

6. Acceptable use

You agree not to: use the Service unlawfully; reverse engineer, scrape, or overload it; misrepresent your identity; upload harmful or infringing content; or use it to provide migration advice to third parties as if you were licensed. We may remove content or restrict access to protect the Service and other users.

7. Intellectual property

The Service, including software, design, and text, is owned by Starmy or its licensors. SkillSelect data is © Commonwealth of Australia and used from public sources. You receive a limited, revocable, non-transferable licence to use the Service for personal, non-commercial purposes. You retain ownership of content you submit but grant us a licence to process it to operate the Service.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind to the extent permitted by law. We do not warrant that information is accurate, that the Service will be uninterrupted, or that it suits your purpose. Certain consumer guarantees under the Australian Consumer Law cannot be excluded and are not affected by this clause.

9. Limitation of liability

To the maximum extent permitted by law, Starmy is not liable for indirect, incidental, or consequential loss, or for any loss arising from visa decisions or reliance on the Service. Where liability cannot be excluded, it is limited to resupplying the Service or paying the cost of resupply. Our total aggregate liability is limited to the fees you paid in the 12 months before the claim.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach or where required by law. Clauses that by nature should survive (IP, disclaimers, liability, governing law) continue after termination.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified via the Service or email; continued use after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of its courts.
